Habush Habush & Rottier, along with Hawks Quindel and Williams Dirks Dameron, recently won a motion certifying hundreds of Cerner employees as a class. The plaintiff claims that she and her coworkers were illegally classified as exempt from overtime, and in a ruling on Tuesday, Jackson County Circuit Judge W. Brent Powell agreed. In his decision, he found that there were enough would-be class members to warrant the class-action designation.
According to the lawsuit, Cerner had 350 delivery consultants in 2013, and in 2015 hired 400 delivery consultants. These employees may have been wrongly exempt from overtime, often due to inflated job titles that did not truly reflect their level of responsibility under the law.
